Common Questions

Frequently asked questions

What is the difference between administrative and judicial divorce in Thailand?

An administrative (uncontested) divorce is registered at the local district office when both parties agree on all terms, including asset division and parenting arrangements. A judicial (contested) divorce is handled through the family court when parties cannot reach agreement. We guide clients through both routes, and explore amicable resolution before approaching the court.

Does a prenuptial agreement need to be signed before or on the wedding day?

Under Thai law, a prenuptial agreement must be registered at the same time as the marriage registration — not before. It cannot be entered into after marriage. Our team works with couples well in advance to ensure the agreement is carefully drafted, reviewed by both parties, and ready for same-day registration at the district office.

How is marital property divided under Thai family law?

Thai law distinguishes between Sin Suan Tua (personal property owned before marriage or received as inheritance/gifts) and Sin Somros (marital property acquired during marriage). On divorce, Sin Somros is generally divided equally unless the parties agree otherwise or a prenuptial agreement provides different terms. We help clarify which assets fall into which category and present division proposals that reflect your situation.

Can a foreign parent obtain custody of a child in Thailand?

Yes. Thai family courts consider the child's welfare as the primary factor in custody decisions, and a parent's nationality is not a disqualifying consideration. Cross-border custody matters — particularly where one parent lives abroad — involve additional complexity, including potential Hague Convention considerations. We assess each situation carefully and coordinate with relevant authorities when needed.

How long do family law proceedings typically take?

Timelines vary considerably depending on the complexity and whether matters are contested. An uncontested divorce can often be completed in a single day at the district office once all documentation is prepared. Contested proceedings or custody arrangements formalised through court can take several months. We provide a realistic assessment of timelines during your initial consultation.

What happens during the initial consultation?

The initial consultation is a private, informal conversation where you can describe your circumstances at your own pace. Our role at this stage is to listen carefully, ask any clarifying questions, and outline the legal options available to you — without any obligation to proceed. We aim to leave you feeling informed and clear about your situation.
